Tribunal annuls Commission decisions in favor of Air France and Air France-KLM

Background

In April 2020, France notified the European Commission of an individual aid measure for Air France, providing a state guarantee of 90% on a 4-billion-euro loan and a shareholder loan of up to 3 billion euros. The Commission determined that only Air France was the beneficiary, excluding all other companies in the Air France-KLM group. In March 2021, France notified the Commission of a 4-billion-euro aid for the recapitalization of Air France and Air France-KLM, with the Commission again determining that only these two entities were beneficiaries.

Legal Action

Ryanair and Malta Air contested these decisions, arguing that they were contrary to EU law. They claimed that the Commission incorrectly defined the beneficiaries of the aid.

The Tribunal ruled in favor of the appellants, examining the ties between the companies and concluding that the holding Air France-KLM and KLM could indirectly benefit from the state aid. This ruling could have significant implications for EU competition laws and state aid regulations.
